You MAY be able to pay your fines and costs by mail, online or in person instead of appearing in court. Please contact the court clerk of the municipality in which your case is located with any further questions.
If you have pled not guilty and your case has been tried in the Clinton Municipal Court, you have the right to appeal your case to the Circuit Court of Henry County, Clinton, Missouri. However, there are certain requirements that must be met in order to appeal your case. The following information will explain what some of the requirements are:
- You have ten (10) CALENDAR days from your court date to post your filing fees.
- The payment of the filing fee is required by the Circuit Court of Henry County and will be assessed on EACH ticket/violation appealed.
- The filing fee MUST be paid by you. Only cash or money order will be accepted. Money orders must be MADE PAYABLE TO THE CITY OF CLINTON MUNICIPAL DIVISION. The $30.00 filing fee amount per ticket/violation is set by the Circuit Court and will be collected on EACH violation you are appealing.
- The Clinton Municipal Court DOES NOT have the authority to alter the requirements or extend the time limitations as described above.
- If the filing fee is not posted within the ten (10) day limit then the original fine and sentence will be imposed.
- If not appealed within the ten (10) days you must appear in court on your court date at
1:30 p.m. to abide by the original sentence or a bench warrant could be issued for your arrest.
1. By pleading guilty, you are waving your right to remain silent. Absent your plea of guilty, the City would have the burden of proving the case against you.
2. If you were involved in a traffic accident at the time of the alleged offense, your plea of guilty could be used later in a civil suit for damages as an admission by you that you were at fault or were the party responsible for the accident.
Under Missouri law, you may be brought to trial only after a formal complaint has been filed. The complaint is the document that states what you are accused of, and that your action was unlawful.
- You have the right to have your attorney assist you through all stages of the proceedings.
- You have the right to inspect the complaint before the trial and have it read to you at trial.
- You are entitled to hear all testimony against you.
- You have the right to cross-examine any witness who testifies against you.
- You have the right to testify in your own behalf if you choose.
- You may call witnesses to testify in your behalf.
- You also have the right to have the Court issue subpoenas for witnesses to ensure their appearance at trial. However, you must obtain proper service of the subpoenas on your witnesses.
- You may be represented by counsel, although it is not required. In cases in which conviction would likely result in a jail sentence, the Court will advise you to seek counsel.

RIGHT TO APPEAL - If you are not satisfied with the judgment(verdict) of this Court, you have the right to appeal the verdict to the Henry County Associate Circuit Court. If you choose to appeal, you must pay a designated appearance bond (cash or money order) to cover filing fees, which will be forwarded to the Circuit Court along with your case files. If a defendant files an application for a trial de novo, the payment of the statutory trial de novo fee shall be waived if the defendant qualifies as an indigent person under the Court's guidelines. If you pay fines assessed, you waive the right to appeal. If you file a trial de novo, you will be notified of a new court date and another Judge will hear your case again in its entirety. You must file this appeal within ten (10) days of judgment or the judgment becomes final and all fines and costs assessed must be paid to the Court.
